Louisiana Criminal Defense and DWI Attorney.

A DWI arrest starts two clocks at once: the criminal case and the OMV license suspension. Miss the administrative deadline and you lose driving privileges before you ever see a judge. Stephen Spurgeon handles both tracks, and helps clients clear their records through expungement.

Cases we handle

These are the matters we have built process around: evidence preservation, records workflow, and one attorney from intake through resolution.

01

DWI / DUI Defense

First offense through felony DWI. Field sobriety, breath and blood testing, and suppression of improperly obtained evidence.

02

OMV License Hearings

The 30-day administrative hearing request that protects your license while the criminal case proceeds.

03

Expungements

Clearing arrests and eligible convictions under La. C.Cr.P. art. 971 et seq. so they stop following you.

04

Restraining Orders

Protective orders under the Domestic Abuse Assistance Act and Protection from Dating Violence Act, for both petitioners and respondents.

05

Misdemeanors

Theft, simple battery, possession, and other charges where a plea can carry lifelong consequences.

06

Bond and Arraignment

Early representation at bond hearings and arraignment to set the case up properly from day one.

How a criminal defense and dwi case works at Spurgeon Law

  1. 1. First 48 hours. Request the OMV hearing, preserve dash-cam and body-cam footage, and get you to arraignment prepared.
  2. 2. Discovery. Every report, video, calibration log, and lab result reviewed line by line.
  3. 3. Motions. Suppression, dismissal, or reduction. Most DWI cases turn on the stop and the testing.
  4. 4. Negotiation or trial. A plea only when it truly serves you. Trial when the evidence does not hold.
  5. 5. Aftercare. Expungement eligibility review once the case concludes.

Frequently asked questions

How long do I have to request an OMV hearing after a DWI arrest?

Thirty days from the arrest date. Missing it means an automatic suspension. Call within days, not weeks.

Can a first-offense DWI be expunged in Louisiana?

Often yes, under La. C.Cr.P. art. 977: immediately after an art. 894 set-aside, or five years after the sentence is completed. A DWI can be expunged only once in a ten-year period, and eligibility depends on the specific disposition.

Should I refuse the breath test?

Refusal has its own consequences under implied consent law, including a longer suspension. The right answer depends on the facts. Get counsel quickly.

Do you handle cases outside Alexandria?

Yes. The firm appears in courts across Louisiana.
