Frequently asked questions
How long does a Louisiana divorce take?
A no-fault Article 102 divorce requires living separate and apart for 180 days (365 if there are minor children) after service. Article 103 divorces can move faster on specific grounds.
What is a domiciliary parent?
The parent with whom the child primarily resides under a joint custody order, and who has decision-making authority when parents disagree. It is not the same as sole custody.
Can I get custody if there was domestic violence?
Louisiana's Post-Separation Family Violence Relief Act creates a presumption against custody for a parent with a history of family violence. This is a specialized area; get counsel early.
How is child support calculated?
By statutory guidelines based on combined adjusted gross income and the number of children, with adjustments for health insurance, childcare, and extraordinary expenses.
Do you handle adoptions?
No. The firm does not handle adoptions of any kind, including stepparent and intrafamily adoptions. The Louisiana State Bar Association's Find Legal Help page can point you to an attorney who does.
